LEGAL TERMS AND CONDITIONS FOR INSTAGRAM GIVEAWAY
1. Organizing Company
The entity BATELA 1991, SL, with Tax ID B75092163 and registered office at Sansinenea Industrialdea / ARROA-BEHEA SS 20749 / Spain (hereinafter, “BATELA” or the “Organizer”), is organizing this promotional giveaway for World Maritime Day, which will take place via the official Instagram profile @batela1991.
Participation in the giveaway implies full acceptance of these terms and conditions.
2. Territorial Scope and Participants
The giveaway is open to all natural persons over 18 years of age, residing in [SPAIN / FRANCE / PORTUGAL / ITALY], who meet the requirements established in these terms.
Employees of the Organizer, their direct relatives, and anyone who has been involved directly or indirectly in organizing the giveaway are excluded from participating.
3. Duration of the Giveaway
The giveaway will be active from 9/24/2026 at 09:15 AM until 9/25/2026 at 11:59 PM, both days inclusive.
Entries submitted outside the established time frame will not be accepted.
4. Participation Mechanics
To participate, it is necessary to:
- Follow the official Instagram profile @batela1991 and “like” the post.
- Comment “MAR” on the giveaway post and mention (using a tag @username) a person who shares your connection to the sea.
- The participant must meet all the requirements indicated in the giveaway post.
Each valid comment will constitute one entry in the giveaway.
Comments containing offensive, discriminatory, illicit, or advertising content, or content that infringes upon third-party rights or is unrelated to the proposed dynamic, will not be valid.
5. Additional Entry via Stories
Participants can obtain one additional entry by sharing the giveaway post on their Instagram Stories and mentioning @batela1991.
For this additional entry to be counted, the participant must send a screenshot of the Story via direct message (DM) to the official profile @batela1991 within the participation period.
The Story must remain published for the standard duration of an Instagram Story and must be verifiable by the Organizer.
The Organizer may request the necessary verifications to confirm the additional entry.
Each participant may obtain a maximum of one additional entry for sharing the giveaway in Stories.
6. Winner Selection
Once the participation period has ended, a random drawing will be conducted among all valid entries using the Easypromos platform.
The following will be selected:
- 1 winner
- 2 alternates
Selection will be made randomly from the entries that meet the requirements set out in these terms.
The Organizer may manually verify that the selected person meets the participation conditions, especially that they follow the @batela1991 profile and have correctly performed the required action.
In the event that the selected person does not meet the conditions, does not respond to the contact made by the Organizer within the established period, or waives the prize, the first alternate will be contacted, followed by the second alternate if necessary.
7. Communication of the Winner
The winner's Instagram username will be announced on the @batela1991 profile in the same giveaway post and/or via Stories.
The Organizer will contact the winner via Instagram direct message to announce the result and request the necessary information for the delivery of the prize.
The winner must respond to the message within a maximum period of 3 days from receipt.
If there is no response after this period, it will be understood that the winner waives the prize, and the next alternate will be contacted.
8. Prize
The giveaway prize will consist of:
GIFT CARD VALUED AT €150 to be redeemed in the online store.
The prize cannot be substituted for its cash value or exchanged for another product or service, unless the Organizer, for justified reasons, determines otherwise.
The prize will be sent to the winner via a direct message to their Instagram account.
Any tax obligation that may arise from winning the prize, in accordance with current legislation, will be the responsibility of the winner under the legally established terms.
9. Fraudulent Entries
The Organizer reserves the right to exclude any entries it considers fraudulent, manipulated, made using fake accounts or accounts specifically created to participate in the giveaway, or that violate these terms.
Likewise, practices intended to artificially alter the normal operation of the giveaway will not be admitted.
10. Personal Data Protection
The personal data that the participant voluntarily provides to the Organizer, especially if they are the winner, will be processed by BATELA 1991 SL, as the data controller, for the purpose of managing the giveaway, verifying compliance with participation conditions, contacting the winner, and managing the delivery of the prize.
The legal basis for processing will be the management and execution of participation in the giveaway.
The data will not be used to send commercial communications unless the interested party has provided their consent for this purpose separately.
Participants may exercise, where applicable, their rights of access, rectification, deletion, opposition, limitation, and portability by sending a communication to customers@batela.com.
Likewise, they may consult additional information regarding the processing of their personal data in the BATELA Privacy Policy, available at https://batela.com/policies/privacy-policy.
11. Instagram
This giveaway is not sponsored, endorsed, administered by, or associated in any way with Instagram.
Participants release Instagram from any liability derived from the organization and development of this giveaway.
Data and content provided by participants will be managed by the Organizer and not by Instagram.
12. Acceptance of Terms
Participation in the giveaway implies the express and unreserved acceptance of these terms.
The Organizer reserves the right to modify, suspend, or cancel the giveaway when circumstances justify it, provided that this does not prejudice the rights acquired by the participants.

13. Applicable Law
This giveaway will be governed by applicable Spanish law.
For any controversy that may arise from the interpretation or application of these terms, the courts and tribunals corresponding in accordance with current legislation will have jurisdiction.
